Engagement terms

This is the agreement between you and Clearpath Tax & Accounting when we prepare your return. You accept it when you send your file through the portal.

1. What we will do

Prepare your federal and state income tax returns for the tax year shown in your portal file, based on the information and documents you provide. We will e-file the returns after you review, approve, and sign the e-file authorization (Form 8879 and any state equivalent).

2. What we will not do

We will not audit or verify the information you give us, except to the extent we notice something inconsistent, in which case we'll ask. We are not responsible for returns or issues arising from information you did not provide or provided inaccurately. Bookkeeping, financial statements, and representation before the IRS are separate engagements.

3. Your responsibilities

Provide complete and accurate information, including all income from every source, whether or not you received a tax form for it. Keep the records that support the deductions and credits on your return โ€” receipts, statements, logs โ€” for at least three years after filing. Review the return before signing; you are responsible for its contents.

4. Substantiation

We will claim deductions and credits you are entitled to and can support. Where records are incomplete, we will help you reconstruct them from evidence, but we will not claim amounts that have no basis. If you ask us to take a position we believe lacks a reasonable basis, we will decline and may withdraw from the engagement.

5. Fees and payment

Fees are quoted in writing before work begins: individual returns from $375, returns with self-employment income from $475, plus any quoted add-ons. Half is due at engagement and the balance when you approve the return. Returns are e-filed after final payment. If you withdraw after work has begun, fees for work completed are due.

6. Timing and extensions

Returns are generally prepared within five business days after all documents are received; longer in early April. If your information arrives too late to file by the deadline, we will file an extension at no charge. An extension does not extend the time to pay; we will estimate any payment due.

7. Confidentiality and data

Your information is used only to prepare your return and is protected as described in our privacy policy. Under IRC ยง7216 we will not use or disclose your return information for any other purpose without your written consent.

8. Records retention

We keep a copy of your return and the supporting file for at least three years after filing, after which it may be deleted. Request copies before that period ends if you want them.

9. IRS or state correspondence

If you receive a notice about a return we prepared, send it to us promptly. Responding to notices is generally included where the issue relates to our preparation; representation in an examination is a separate engagement.

10. Limitation of liability

Our liability for any error in preparation is limited to the fee paid for that return. We are not liable for penalties or interest resulting from information you did not provide, provided late, or provided inaccurately.

11. Termination

Either of us may end this engagement in writing. Fees for work completed to that point are due.
